Chile: Prosecutor goes to Supreme Court to increase fines on supermarkets

Chile’s National Economic Prosecutor will seek to make the Walmart, Cencosud and SMU companies pay the maximum fines they had requested, equivalent to some US$27 million, showing their disagreement with the ruling issued by the Tribunal for the Defense of Free Competition (TDLC). Therefore, the entity has issued an appeal to the Supreme Court, seeking to reverse said ruling.

The Office of the Prosecutor (FNE) asked the Supreme Court “to amend this judgment (…) providing definitively for the increase of the fine imposed on Cencosud, SMU and Walmart […] to the amount that the Supreme Court determines to correspond according to law, with express sentencing in costs for each one of them “. The FNE has suggested an amount of 30,000 UTD, equivalent to US$27 million.

The ruling also left the three supermarket chains unhappy, and they have also announced they will appeal to the highest court as they deny having participated in any price coordination.
