El Salvador: Supreme Court asks for guarantees to competition and transparency in Metropolitan Transportation System contracts

The Supreme Court of El Salvador struck down the bidding process for the Sitramss transport system, calling out against the illegal privatization of public roadways, and giving one year for the Legislative Assembly to process the concession or awarding of the project to interested companies, while also imposing requirements for said tender to be carried out with transparency and respecting the competition processes.

“The bidding process must respect the principles of free competition, among which are competition and advertising,” the Court said, noting also that there should be no secret or confidential information concerning the tender.

“The economic agents interested in contracting with the public administration must present the best offers so that, among them, a competition that promotes quality, efficiency, cost and added value for the products can be generated,” the Court concluded.
