Experience:
By background and training, Elaine is a litigator with experience of broader commercial law issues. As a consequence, she has a complete overview of the competition and tactical litigation issues arising in relation to any contentious competition matter.
Over the last decade, she has been involved in many of the most significant competition damages cases brought in England, before the High Court, the Competition Appeal Tribunal and the Court of Appeal.
Her experience also includes coordinating multi-jurisdictional litigation on behalf of claimants and advising defendants on proactive litigation strategies, as well as advising prospective defendants on options for avoiding litigation.
In addition, she has extensive experience in advising clients on investigations by the European Commission, the Office of Fair Trading and other competition regulators.
She has expertise in challenging regulatory decisions, before both the Competition Appeal Tribunal and the General Court of the European Union, and in bringing judicial reviews of legislation implementing EU directives in a number of EU jurisdictions.
