Court confirms jurisdiction over Kuehne+Nagel in freight forwarding cartel case

The Court of Appeal has confirmed that the New Zealand High Court has jurisdiction over the Commerce Commission’s case against Kuehne+Nagel. According to the Commerce Commission, Kuehne+Nagel and competing freight forwarders formed a cartel to collude on surcharges. Kuehne+Nagel challenged the case on the ground that as a Swiss holding company that is not involved in freight forwarding, it could not be responsible for the acts of its New Zealand subsidiary.
