EC probe into Samsung’s patent infringement suits

The European Commission has opened a formal investigation into whether Samsung has violated a commitment it had given to the European Telecommunications Standards Institute (ETSI). In 1998, Samsung had committed to license any of its “standard essential patents relating to European mobile telephony standards on fair, reasonable and non-discriminatory terms.” Yet in 2011, Samsung sought injunctive relief in various Member States from rival mobile device makers, citing patent infringements.

The probe will determine if Samsung’s failure to honor its commitment constitutes an abuse of dominance under Article 102 of the TFEU.
