The Malaysia Competition Commission (MyCC) has issued a “proposed decision” regarding the purported price-fixing activity of the Cameron Highlands Floriculturist Association (CHFA). The “proposed decision” acts as a notice of both incriminating facts discovered and a proposed penalty, and the CHFA has an opportunity to rebut assertions before the ruling is final. The CHFA, a collective of 100 members selling to wholesalers throughout Malasia, is under fire after a news report quoted the organization’s president as stating members agreed to raise prices by 10 percent. The penalty for price-fixing will not exceed 10 percent of worldwide profit during the period of infringement.
