Spain Regulator Can’t Refer Questions To ECJ In Dockworkers Case

The European Union’s highest court refused Wednesday to answer whether Spanish dockworkers’ latest collective bargaining agreement reforming the union-dominated sector violates antitrust rules.

The Court of Justice of the EU (CJEU) has declared inadmissible a request for a preliminary ruling submitted by the National Commission of Markets and Competition (CNMC) on the new stowage agreement, considering that this body is not a judicial body national who may submit a request for a preliminary ruling of this type.

The CNMC imposed a sanction on the signatories of the IV Agreement for the regulation of labor relations in the port stowage sector, considering that the clauses relating to the subrogation of workers are contrary to competition. Then, the watchdog decided to consult the EUCJ.
