US: 2009 auto parts antitrust victor to pursue $2B against rival

Car parts manufacturer Meritor, which emerged victorious in 2009 against rival Eaton in a lawsuit accusing the latter of antitrust violations, has been approved to pursue damages in the case that could top $2 billion

Meritor sued Eaton over allegations that Eaton used unfair, exclusive deals to offer rebates to its customers that Meritor said harmed competition in North America and lead to Eaton controlling 90 percent of the truck transmissions market.

Eaton had pursued a last-minute ruling, asking a judge to exclude Meritor’s expert testimony from the damages trial; I District Judge Sue L. Robinson released an opinion Thursday that said Eaton could not pursue the move so close to the trial’s start date.

The damages trial is set to begin next week.
