US: FTC calls DOJ’s request for hearing in Qualcomm case “untimely”

The US Federal Trade Commission (FTC) is pushing back against the Justice Department’s request to be heard on any potential sanctions against Qualcomm in a pending anti-monopoly case in San Jose federal court.

In a two-page filing on Thursday, May 9,, the FTC called the Justice Department’s efforts last week to intervene in the case “untimely.” The agency noted that it did not “participate in or request” that the Department of Justice weigh in.

“Among other things, the (DOJ) submission ignores this court’s prior orders and the parties’ briefing on remedy and misconstrues applicable law and the record,” wrote FTC lawyers.

Last week, the Antitrust Division of the Justice Department requested that if Judge Lucy Koh rules that Qualcomm violated antitrust law, she hold an additional evidentiary hearing before requiring changes to Qualcomm’s business practices.
