US: Updated antitrust guidelines for licensing of IP issued

The United States Department of Justice and Federal Trade Commission today released updated antitrust guidelines for the licensing of intellectual property.

The guidelines are for the public and businesses to better understand the enforcement approach of the federal antitrust agencies. The update followed a comment period based on a draft made available in August.

This update modernizes the IP Licensing Guidelines, which the agencies jointly issued in 1995, so they may continue to play a fundamental role in the agencies’ analysis of the licensing of intellectual property rights and provide guidance to the public and the business community about the agencies’ enforcement approach to intellectual property licensing.
