Brazil’s competition authority has released the English version of their FAQ document, detailing the agency’s Leniency program for competition violations. The document is a compilation of best practices and procedures established by the Council when negotiating with companies under leniency agreements.
The document represents a milestone for the agency, marking 15 years of experience in attempting to bring national legislation in line with international best practices. The FAQ is intended to strengthen and expand the agency’s ability to increase transparency and trust during negotiations and when first considering a leniency agreement.
CADE’s FAQ is not legally binding, intended only as an informative too. With the release of the new version the Agency has also announced an extension to the deadline for receiving suggestions and comments on their Leniency law, which can be submitted by the public and other international agencies before February 16th, 2016.
