CNC finds obstacles to competition in professional services sector

The Comisión Nacional de la Competencia (CNC) has released its report on competition in the professional services sector following the transposition of the EU Services Directive 2006/123/EC. The CNC found that although reforms had established a new national regulatory framework, the framework has not yet been fully incorporated into the Professional Colleges. The internal rules of the Professional Colleges “continue reflecting or favouring numerous constraints on competition.” Furthermore, regional authorities have unevenly adopted the revised national laws.

To incorporate the new regulatory framework, the CNC advises that (1) the Professional Colleges to review their internal rules; (2) the regional governments to review their laws to make them consistent with national ones, and; (3) the national government’s creation of a clear definition and catalogue of which professions require mandatory membership in Professional Colleges.
