There is no doubt that disloyal competition is one of the hardest practices to regulate for any legislator, and one of the most vague and difficult to interpret for those who are charged with applying the law.

The following study analyses the concept of Unfair competition, starting by establishing the judicial figure covered by current norms. The study goes on to study common assumptions regarding articles 8 and 19 in in the 1996 Law 256, as well as its judicial character and reach.
