U.S. District Judge Denise Cote denied Apple and five other publishers’ motion to dismiss an eBook price-fixing class action lawsuit. The suit, originally filed on August 9, 2011, is separate from the eBook price-fixing case brought by the DOJ. The class action plaintiffs are represented by Hagens Berman of Seattle, WA. They allege that the publishers conspired to fix and raise eBook prices. The defendants in addition to Apple are HarperCollins, Simon & Schuster, Hachette Book Group, Macmillan, and Penguin. All five were also named defendants in the DOJ’s eBook case, which HarperCollins, Simon & Schuster, and Hachette have already settled.
The case is In Re Electronic Books Antitrust Litigation, 11-MD-2293, U.S. District Court, S.D.N.Y.
