Exceptional Circumstances Caused By The Coronavirus To Affect The Application Of The Finnish Competition Act.

The Finnish Competition and Consumer Authority (FCCA) will take into account the exceptional circumstances caused by the coronavirus when applying the Competition Act.

During Finland’s state of emergency, companies may need to work together to ensure adequate supply or the equal distribution of products to all consumers. The FCCA will not intervene in measures that are necessary to ensure the sufficient availability of products. You may contact the agency for instructions and guidance if you are uncertain about the permissibility of cooperation.

Even during the state of emergency, the FCCA will resolutely intervene in cartels between companies, which aim to raise prices to the detriment of consumers. The same will apply to abuse of a dominant position, which a company uses to exclude competitors from the market or to charge manifestly unfair prices.
