Mexico: COFECE begins investigation into airlines

Mexico’s Federal Economic Competition Commission (COFECE) has announced the start of a probe into possible antitrust violations among the country’s airline operators. The search will focus on absolute monopolistic practices, such as collusion, non-competition agreements or other deals between competitors.

Should any such violations be detected COFECE could impose sanctions that range from the banning of executives for five years and a fine equal to 10% of annual earnings, up to 10 year prison sentences for any individual who participates or facilitates this conduct.

COFECE officials were quick to point out that the probe does not entail the existence of any responsible actors, but rather is simply part of the Agency’s verification duties. COFECE will have up to 120 days to perform their research.
