Mexico: Watchdog opens Barley market probe

Mexico’s competition watchdog COFECE has announced the results of a preliminary investigation, which has found sufficient elements to suspect a lack of competition in the production, distribution and sale of barley destined for beer production. The authority has therefore decided to launch a full investigation into this important economic activity.

COFECE authorities will consider ‘barriers to entry and free association’ any structural characteristics of the market, as well as any acts performed by economic agents with the aim of blocking access to possible competitors by limiting their ability to compete, distorting the market.

Once the results of the investigation are in, COFECE will be able to resort to an arsenal of measures to correct any irregularities, including ordering a divestment of assets sufficient to eliminate anti-competitive effects.
