Labor Grievance Arbitration’s Differences

Labor grievance arbitration differs profoundly from other arbitration in the United States. Labor grievance arbitration’s differences from other arbitration are many, and they largely spring from the same source—the National Labor Relations Act’s encouragement of labor cartelization. This Article surveys labor grievance arbitration’s many important differences from other arbitration and explains how labor grievance arbitration’s differences trace back to the NLRA’s encouragement of labor cartels.
